Court verdict on conscription evasion scheme
The Hertsa District Court of Chernivtsi Oblast approved a plea bargain regarding Tetiana Dmytrivna Ungurian-Urs, who previously held the position of juror. The woman was sentenced to five years of imprisonment, but was released from serving the sentence with a probation period of one and a half years.
In addition, the defendant agreed to transfer 600,000 hryvnias to the needs of the Armed Forces of Ukraine and to provide the court and the prosecutor with a copy of the relevant payment document.
Mechanism of illegal deferment acquisition
According to the case materials, Ungurian-Urs, who had a wide circle of acquaintances and was included in the list of jurors by a decision of the Dnistrovskyi District Council, agreed with court employees, representatives of the Chernivtsi branch of the State Institution "Institute of Forensic Psychiatry and Forensic Medicine of the Ministry of Health", and other unidentified persons. The aim of the conspiracy was the illegal adoption of court decisions recognising individuals as legally incapacitated and establishing guardianship over them.
This status gave men the right to a deferment from mobilisation and the possibility of leaving the country. For the adoption of a decision and the provision of a knowingly unfounded forensic psychiatric expert opinion, the organisers demanded money. According to the juror, the judge named such rates: $3,000 for the adoption of a court decision and $200 for the court experts. Court hearings were held without the participation of the applicant and other participants in the case.
Specific episode: the 2023 family case
In 2023, under this scheme, a woman was recognised as suffering from a chronic mental illness without an actual examination, deemed unable to understand her actions and control them. Her son was appointed as her guardian by the judge. The wife handed the juror $3,000 "for the decision" and $200 for the expert. The guardianship decision was in force for two years.
At the end of 2025, the family again approached the juror with a request to extend the guardianship. Then, the judge allegedly stated that the rates had increased: now $6,000 had to be paid for each decision, and $800 for the expert.
Extension of the decision and departure abroad
Under circumstances that have not yet been reliably established, the judge allegedly organised the drafting of a motion to extend the validity period of the decision on behalf of the applicant. The deputy head of the apparatus of the Khotin District Court registered this motion as materials to an existing case, rather than as a new one, which caused it to again fall to the same judge.
The applicant's mother was not brought to the institution for the examination, and no actual psychiatric examination was conducted. On 23 December 2025, the judge, in the absence of participants, issued a decision extending the period of the woman's recognition as legally incapacitated and leaving her son as the guardian.
After receiving the paper copy of the decision, the man again obtained a deferment from conscription and left the country for Romania.
Charges and case details
In June 2026, the juror was dismissed from the court. In August, she was notified of suspicion of aiding in the preparation and provision to the court of a knowingly false expert opinion for mercenary motives (Part 5 of Article 27, Part 2 of Article 384 of the Criminal Code of Ukraine), obstructing the lawful activities of the Armed Forces (Article 114-1 of the Criminal Code of Ukraine), and facilitating the illegal transfer of persons across the state border by an official using their official position, committed repeatedly, by prior conspiracy by a group of persons, and for mercenary motives (Part 3 of Article 332 of the Criminal Code of Ukraine).
It is worth noting that a corruption crime was not charged against the former juror. The case materials mention the implementation of a joint criminal intent with a judge. The decision in case No. 724/2773/23 regarding guardianship was made by Judge Oleksandr Yefentieiev, who currently still administers justice.
