During the investigation into negligence in office, linked to the consequences of the massive attack on Kyiv on 9 January 2026, law enforcement officers identified signs of abuses in the procurement of equipment for municipal enterprises. Specifically, it was established that Kyivvodokanal purchased equipment worth UAH 58.85 million at prices that, according to the investigation, were inflated by 20–30%.
Investigation context: attack aftermath and proceedings
On 9 January 2026, Kyiv suffered a massive strike: 240 drones and 36 missiles were used, four people died, and critical infrastructure was damaged. As a result, certain districts of the city were left without heating and water supply. On 15 January, six days after the incident, the Kyiv police opened criminal proceedings for negligence in office that caused serious consequences.
During investigative actions, the police and the Security Service of Ukraine (SBU) seized documents regarding the capital's preparation for operating under attack conditions, the protection of critical infrastructure facilities, and the conduct of relevant procurements. Although the names of institutions are anonymised in court rulings, the context indicates that the Kyiv City Council, the Kyiv City State Administration (KMSA), and their subordinate enterprises are involved, specifically JSC "AK Kyivvodokanal" and the municipal enterprise "Kyivteploenergo".
Expert conclusions: delays and funding shortages
The case materials contain conclusions from specialists involved in analysing the documents. They established that the Kyiv development strategy and city programmes were updated "with significant delay". Also, despite funds being available in the budget, the city failed to ensure adequate funding for critical infrastructure operators. This led to the postponement of work completion deadlines to the end of 2026.
The investigation links these violations to the disconnection of electricity, water, and heating on 9 January 2026. The total damage was assessed at UAH 29.15 million in unplanned expenses. The allocation of funds is as follows:
- UAH 11.48 million — assistance to 287 Kyiv residents whose apartments were damaged;
- UAH 14.02 million — expenses of municipal housing management companies;
- UAH 1.51 million — funds from the state budget;
- UAH 2.14 million — funds from the joint-stock company.
Regarding the municipal enterprise "Kyivteploenergo", investigators gained access to primary documents (acts, estimates, commercial proposals) concerning the construction of engineering protection for the thermal power plant, backup power supply, and the installation of a cogeneration unit.
Kyivvodokanal procurements: signs of collusion
The procurements by Kyivvodokanal, aimed at ensuring backup power for water supply and sewage, are described in the most detail in the rulings. Specifically, the purchase of nine diesel generators for a total of UAH 243.41 million under an agreement dated 19 December 2025 is mentioned. The investigation believes that the technical specification for this equipment "has certain discriminatory features regarding other manufacturers".
Also, to operate these generators, the water utility concluded three agreements for equipment with a total value of UAH 58.85 million. According to the investigation, the supply was carried out at prices inflated by 20–30%. The winner was LLC "Enerzhigroup". The documents state that the contractor and the water utility established an "unlawful mechanism" aimed at misappropriating budget funds.
The scheme of the subject's activities was as follows: initially, the company was awarded 18 direct contracts for designing backup power supply for a total of UAH 9.46 million, and subsequently it received seven construction contracts for a total of UAH 320.69 million. "Enerzhigroup" was the sole participant in these tenders, which, in the opinion of the investigation, "indicates prior collusion" and "artificial creation of anti-competitive actions". Furthermore, according to the investigation, the company plans to supply "Schneider Electric" converters of Chinese origin with a price markup of 15–20%.
Ties between "Enerzhigroup" and energy sector leadership
The "Prozorro" system currently registers 57 contracts between "Kyivvodokanal" and "Enerzhigroup" for a total of UAH 599.64 million. Thus, the water utility became the largest customer of this company. "Enerzhigroup" is also a top contractor for a number of regional power distribution companies and was featured in materials regarding the redistribution of the transformer market.
LLC "Enerzhigroup" was registered in Dnipro at the end of 2015 under the name "Best Production". In the spring of 2016, the company changed its name, moved to Kharkiv, and transferred to the current owner and director, Maksym Desiatkov.
The company's assets include contracts totalling UAH 3.94 billion. Of this amount, UAH 2.13 billion is attributable to eight regional power distribution companies, seven of which are part of the state group JSC "Ukrainski Rozpodilchi Mrezhi" (URM, Ukrainian Distribution Grids).
Maksym Desiatkov also manages and co-owns LLC "Estate Energy" together with Iryna Harmash. Iryna Harmash is the wife of Andriy Harmash, the former head of the municipal enterprise "Kharkiv Metro", who has held a leadership position in the Construction Department of the Kharkiv City Council since 2024.
Until September 2026, a co-founder of "Estate Energy" was Viktoria Belotska — the wife of Oleksiy Belotsky, who was appointed acting general director of the state URM in August 2026. Prior to this, Belotsky worked as the director of the Capital Construction Department of the Kharkiv Regional State Administration, was an advisor to the Kharkiv Regional Military Administration on infrastructure development issues, headed the economics and finance division of JSC "Ukrainski Rozpodilni Mrezhi", and served as an advisor to the minister. From November 2023 to July 2026, he held the position of deputy general director of JSC "Ukrainski Enerhetychni Mashyny" (Ukrainian Energy Machines).
It is worth noting that the offices of "Enerzhigroup" and JSC "Ukrainski Enerhetychni Mashyny" are located in the same building. In addition to the Kyiv proceedings, "Enerzhigroup" contracts were seized during searches in a criminal case concerning the procurement of cogeneration units for the municipal enterprise "Kharkiv Heat Networks".
