Discrepancies between document dates and construction facts
The State Inspectorate of Architecture and Urban Planning of Ukraine (DIAM) has decided to conduct an unscheduled inspection of a facility on Kozatska Street in Kyiv's Holosiivskyi district. This conclusion is contained in a commission document dated 6 October 2026, number 154/02-4-02/26. The commission reviewed a petition from Ihor Dyak regarding the verification of information in a declaration of readiness of the facility for operation, registered on 2 September 2026 under number IU101260827738.
The key issue was a chronological contradiction. On 11 August 2026, the inspectorate registered a notification of the start of construction works. According to the project documentation, the construction of a new commercial building of consequence class CC1 was planned on the plot. By 26 August, a primary technical inventory document had been issued, and on 2 September, a declaration of readiness for operation. The total area of the facility is 3,528.22 square metres. Formally, according to the documents, construction lasted only three weeks.
However, the applicant provided photographs taken on 12 August 2026, i.e. the day after the registration of the start of works. The images show that the building was already fully constructed at that time. This indicates that the structure was erected before the official start of the construction process.
Non-compliance of actual parameters with the project
The commission's conclusion also noted a discrepancy between the actual state of the facility and the registered documentation. By external features, the structure is a multi-apartment residential building five to six storeys high. In contrast, the project documentation specifies three storeys and a mansard.
An additional argument in favour of the building's residential purpose was the fact of apartment sales via the website of the 450 GROUP network, which positions itself as a network of income-generating buildings in Kyiv. The commission emphasised that residential buildings higher than four storeys cannot belong to consequence class CC1, therefore the declared class also requires verification.
The land plots on which the structure is located have a designated purpose for the construction and maintenance of commercial buildings. Andrii Kharchenko is listed as the owner of these plots.
History of conflict and previous inspections
Problems with development on this street have persisted since at least 2025. At that time, residents of the district appealed to the architectural and construction control authorities, claiming that construction was carried out without proper permits. In October 2025, the Ministry of Communities and Territories Development approved the conduct of an unscheduled inspection. However, as noted in the new DIAM conclusion, the inspection did not take place at that time, and no materials were compiled based on its results. This is evidenced by a letter from the Department of State Architectural and Construction Control of the city of Kyiv dated 28 November 2025.
The commission emphasised that the current petition concerns a new subject of inspection — the authenticity of the notification of the start of works dated 11 August 2026 and the declaration of readiness of the facility dated 2 September 2026. These documents did not exist at the time of the previous attempt at control.
Separately, the applicant provided materials regarding possible violations of minimum fire and sanitary setbacks between the new building and neighbouring private residential houses. Following the review, the DIAM commission concluded that the stated circumstances may be grounds for conducting an unscheduled inspection.
It is worth noting that this is not the first facility associated with 450 GROUP to raise questions among the public. Previously, information emerged about a club-style high-rise in the private sector of Holosiiv, which was built in violation of building codes, as well as about a high-rise in Kyiv's Sviatoshyn district, which DIAM refused to legalise.
