The High Anti-Corruption Court (HAC) handed down a verdict against former member of the board of directors of Centrenergo JSC, Oleksandr Uvarov. Judge Oleksiy Kravchuk found him guilty of negligence in office and sentenced him to three years in prison. The decision was made in absentia, as the defendant is on the run.
It is worth noting that during the trial, Judge Oleksiy Kravchuk went beyond the scope of the original indictment. Instead of abuse of office, which was included in the original charges, Uvarov's actions were reclassified as negligence in office. In addition, he was acquitted of committing official forgery.
The key issue remains the compensation for damages. The court left unexamined the civil claim by Centrenergo JSC, which sought to recover 176.83 million UAH from Oleksandr Uvarov and two other individuals.
The Specialized Anti-Corruption Prosecutor's Office (SAP) previously sent to court the materials of a criminal case concerning the infliction of damages amounting to approximately 176 million UAH. According to the investigation, in 2020, Centrenergo JSC concluded an electricity sales agreement with United Energy LLC, which won the auction.
Investigators established that the auction winner did not withdraw the contracted volumes of electricity, which obliged it to pay a penalty. To avoid financial sanctions, additional agreements were concluded with the JSC retroactively. These documents excluded provisions on the permissible limits of deviation from the volumes of electricity withdrawn under the main contracts.
The amendments made allowed United Energy LLC to withdraw any volumes of electricity, despite the fact that, under the terms of the conducted auctions, the withdrawal of the contractual volume was to be guaranteed. As a result of these actions, Centrenergo JSC did not receive 176.8 million UAH.
