On 22 October, the Northern Appellate Commercial Court in Kyiv reviewed two appeals filed by Farmasel LLC. The company was challenging decisions of the Commercial Court of the City of Kyiv dated 27 August 2026, which provided for the recovery of funds in the amount of approximately 60 million hryvnias.
During the hearing, the panel of judges headed by Judge Serhiy Stanik rejected Farmasel's motion to postpone the case, which had been filed due to the need to review the response from Niko LLC, sent on 21 October. At the same time, the panel, on its own initiative, declared a recess until 12 November 2026 to hear other participants in the proceedings and consider other motions.
(Meaning, the panel has consulted and decided: we are rejecting your motion, but we will postpone the hearing. We would like to hear another motion to implement the principle of procedural expediency. Because if we immediately postpone the session now, we will not hear the participants and those motions we would like to consider, given the numerous recesses), the judge noted.
Farmasel LLC, which operates under the Nikopharm brand, manufactures 39 registered drugs. Of these, 14 are included in the National List of Essential Medicines, and 6 directly meet the needs of the Security and Defence Forces. These are primarily injectable solutions and emergency care supplies for hospitals and military hospitals.
The company's position remains unchanged: the recovery of funds could cause the bankruptcy of the enterprise, which is a manufacturer of critically important medicines. According to Farmasel representatives, the situation has intensified due to court decisions and actions by law enforcement agencies, which make normal operations impossible.
The enterprise also imports medicines for the markets of Ukraine and the European Union. If production stops, hundreds of employees may lose their jobs.
A lawyer for Farmasel LLC stated that the company has become the target of a raiding takeover. He recalled that on 7 July of this year, more than 11 searches were conducted at the premises of individuals and at the legal addresses of the enterprise.
(A large number of documents were seized; we could not even record exactly which ones, because they were simply collected in large bags. Accordingly, rulings on the freezing of funds were issued, and decisions by enforcement officers in enforcement proceedings on the freezing of funds were issued. This makes it impossible to pay employees' wages in full, to work fully. Currently, the enterprise is indeed in a state of collapse. We are a critically important enterprise for the country... we produce medicines that are included in the national list, recommended for the soldier's first aid kit, we regularly provide assistance to our army, we supply medicines to leading almost all hospitals in our country), the lawyer noted.
He also accused the courts of systemic procedural violations, claiming that decisions are made without real hearings and the participation of the parties. The lawyer demands a real review of the case on the merits.
The lawsuit against Farmasel was filed within the bankruptcy proceedings of Niko LLC, which belongs to the orbit of Serhiy Dyadechko, a former business partner of the company. Before the start of the hearings, representatives of the Farmasel workforce gathered near the court building with demands for transparent justice.
(Today, a hearing is taking place at the Northern Appellate Court in a case that, in the opinion of the employees, has the signs of a raiding case. Today, the Farmasel company workforce has gathered here. Employees came to defend their interests. People cannot work. This is a workforce that supplies our defenders with medicines and imports medicines that are needed not only in our country but also in the European Union. Today, people are calling for their rights to be protected), a correspondent from the scene reported.
Previously, on 29 September, the Northern Appellate Commercial Court refused to satisfy Farmasel's appeal regarding the asset freeze, leaving the first-instance court's decision of 7 July unchanged. Representatives of the enterprise have already filed a cassation appeal.
