Global dimension of the problem requires a broad circle of participants
The Special Tribunal, established to investigate and prosecute Russia's crimes in Ukraine, should not be perceived exclusively as a European-scale instrument. As Esposito emphasised, this issue has a global character, so countries located outside Europe need to be involved in the process.
“The Special Tribunal should not be viewed merely as a European solution to a problem that actually has a global dimension,” he stated.
Institutional basis and conditions for legitimacy
According to Esposito, the Council of Europe has already taken a significant step by providing the institutional foundation for the creation of the tribunal. However, its international legitimacy will depend on the breadth of the circle of states that become its participants.
The involvement of countries outside the European region becomes a key factor. Broad international participation will be an important condition for its legitimacy.
Call for support of UN resolution and compensation for damages
Esposito appealed to all states that supported the relevant resolution of the UN General Assembly, calling on them to join the Special Tribunal.
Particular emphasis was placed on the need to expand international participation in the activities of the Commission for the consideration of claims for compensation for damages inflicted on Ukraine as a result of Russian aggression.
