The Specialised Anti-Corruption Prosecutor's Office (SAP) announced a change in the legal qualification of one of the episodes in the criminal proceedings against former Deputy Prime Minister Oleksiy Chernyshov. The sum of $500,000, previously cited as illicit enrichment, is now being considered as money laundering.
Reaction from defence and prosecution
The SAP commented on the change in the episode's status in response to a statement by the suspect's defence counsel. Lawyer Oleksandr Rusyn previously told Ukrainian News that the National Anti-Corruption Bureau (NABU) had excluded one of three episodes of illicit enrichment from the suspicion. According to the defence, this effectively amounts to an admission of a "false accusation".
However, prosecutors rejected this explanation. The SAP emphasised that after the initial notification of suspicion was served, the investigation obtained evidence of the criminal origin of part of the funds.
"The basis for changing the suspicion was not a 'false accusation', as the suspect's defence counsel stated in comments to journalists, but the qualification of one of the episodes of obtaining funds as a more serious criminal offence," the SAP stressed.
Details of the charges
According to prosecution data, this concerns the acquisition and use of $500,000 to finance the construction of residences in a cottage town near Kyiv. These actions are now qualified under Article 209 of the Criminal Code of Ukraine, which provides for liability for the laundering of property obtained by criminal means.
An important detail is that this episode has been incorporated into the "Dynasty" episode. Thus, the investigation's claims regarding the specified sum remain intact; only its legal characterisation has changed to a more serious one.
Currently, within the framework of the "Midas" case, Oleksiy Chernyshov is charged with two components: illicit enrichment and money laundering.
