Accusations of deliberate process delay

Public and political figure Mykhailo Ratushnyi released a video address following a session of the Ternopil City District Court, in which he alleged cynical actions by the defendants in the case concerning the rights to the works of artist Ivan Marchuk. According to him, the opposing side is deliberately dragging out the review of the case, counting on the artist not living until its conclusion.

Ratushnyi emphasised that the preparatory stage has already lasted a year and a half, yet the court has still not moved to hearing the case on the merits. He claims that the defendants' representatives constantly submit new requests and materials, leading to endless slowing down of the process.

Counting on the artist's advanced age

According to the public figure's assessment, the opponents' strategy lies in exploiting Ivan Marchuk's advanced age. Ratushnyi suspects that the defendants hope to retain the rights to the artist's works in the event of his death before a court decision is issued.

«Мені здається, така цинічна, брутальна справа — розрахунку на смерть людини в доволі поважному віці» ("I think this is such a cynical, brutal case — counting on the death of a person of quite a respectable age"), Mykhailo Ratushnyi stated in his video address.

Details of the dispute and case figures

The court proceedings concern an agreement on the transfer of intellectual property rights to the works of the world-famous artist, a native of the Ternopil region. According to Ratushnyi, this agreement involves the transfer of rights for the sum of 10,000 hryvnia. Ivan Marchuk himself believes that the document was obtained by fraudulent means, which is why he is challenging its validity.

The case involves former advisor to Interior Minister Arsen Avakov, Mykhailo Apostol, and his son Ihor Apostol.

Results of the handwriting expert examination

Mykhailo Ratushnyi also reported that a handwriting expert examination established the forgery of the signature of one of the case figures. However, in the released video, he did not cite the expert conclusion itself.

The public figure expressed hope that the court will protect the artist's rights. It should be noted that the claims of deliberate process delay and counting on the artist's death are exclusively Mykhailo Ratushnyi's assessment. The defendants' positions regarding these accusations were not voiced in the video.
