Does a defect in an entry mean automatic loss of work experience?

The presence of inaccuracies in an employment record book, such as a missing stamp, signature, or errors in personal data, may complicate the pension application process. However, this is not equivalent to the automatic loss of insurance work experience. In many cases, periods of employment can be confirmed using other documentary evidence.

What to pay attention to when checking the document

The employment record book remains a key document for verifying work experience for periods when information on employment was not fully reflected in electronic registers. Experts recommend not postponing the check to a later date, but doing it in advance, without waiting to reach pensionable age.

First of all, one should inspect the first page. The surname, first name, and patronymic must be recorded in full, and the date of birth must exactly match the data in the passport. It is also important to ensure that entries are certified by signatures in accordance with the rules in force at the time of processing.

Particular attention should be paid to pages with information on hiring and dismissal. For these entries, the accuracy of dates, clear indication of the grounds for HR decisions, and the presence of details of the relevant orders are critically important.

Which documents will confirm work experience in the absence of entries

If there is no stamp or signature in the employment record book, this may create obstacles to confirming a specific period of work, but it does not negate the fact of employment itself. The procedure in such situations is regulated by Cabinet of Ministers of Ukraine Resolution No. 637, which defines the mechanism for confirming work experience for pension assignment in the absence of an employment record book or relevant entries in it.

In case of violations found in the execution of entries, work experience can be confirmed by alternative sources. These include:

  • certificates from the enterprise or institution where the person was employed;
  • excerpts from orders on hiring and dismissal;
  • personal accounts and statements on wage accruals;
  • written employment contracts and other documents that record employment relations;
  • data from the register of insured persons.

The list of required papers may vary depending on the specific period of work, the nature of the inaccuracies found, and the availability of other evidence.

Algorithm for correcting errors

If a citizen notices inaccuracies in their personal data or employment records, the first step should be to identify the enterprise that made the entry and to search for primary documents on the basis of which it can be verified.

If possible, one should contact the employer or its legal successor to clarify information and correct errors in the established order.

If the enterprise has been liquidated, it is possible to try to obtain the necessary documents at an archival institution where HR materials are stored. Additionally, it is worth checking information on employment activity and payment of insurance contributions in the register of insured persons.

It is important not to make corrections to the employment record book independently. Any changes must be executed exclusively in the established order on the basis of relevant documents.

Why it is better to check in advance

Problems with confirming work experience most often surface precisely during the collection of the document package for pension assignment. At that time, searching for archival certificates, orders, or wage statements may require additional time.

Therefore, a rational solution is a preliminary check of the employment record book, cross-referencing work dates with available documents, and clarifying whether the relevant periods are reflected in the electronic register.

It is important to consider that requirements for the execution of employment record books have changed over time. Therefore, the absence of a certain detail must be assessed in light of the rules that were in force at the time the entry was made, and not only through the prism of current norms.

Thus, errors in an employment record book do not always lead to the loss of pension work experience. However, a timely check of documents will help identify potential problems and prepare evidence of employment activity before applying for a pension.

It was previously reported that the Government of Ukraine changed the rules for confirming insurance work experience for pension assignment so that citizens would not lose the right to payments due to the loss of an employment record book or other documents. If data in state registers is insufficient, work experience can be confirmed by other documents or the testimony of at least two former colleagues, in whose search the Pension Fund will assist. The innovations are particularly important for people whose documents were destroyed or lost due to war, hostilities, or occupation.
