The Cabinet of Ministers of Ukraine carried out a major rewrite of the draft decree on mobilisation deferment. According to data obtained by EP, the changes affected up to 90% of the document's text. This government response was a consequence of criticism from business associations and defence enterprises.
Changes in quota calculation
The key point of contention was a provision proposed by the Ministry of Economy in the initial version dated 8 October. The draft stipulated that when calculating the number of individuals an enterprise is obliged to defer, employees who already have other legal exemptions from conscription would not be taken into account. This category includes students, parents of multiple children, and individuals providing care.
If this provision had been approved, the number of deferred employees at many enterprises would have significantly decreased. For example, if an enterprise employs 100 liable persons, and 30 of them have other exemptions, under the old draft the company could have deferred only 35 individuals instead of the standard 50.
Government decision
During closed government discussions preceding the approval of the document, this idea was abandoned. As one member of the Cabinet of Ministers noted, it was then that up to 90% of the text was changed: «Там змінилося до 90% документу» (There, up to 90% of the document was changed). The government decided to retain the current principle of quota calculation, which does not exclude employees with other exemptions from the deferment base.
The final version of the decree has not yet been approved. Following the government meeting on 13 October, officials were given five days to refine the document.
