Regulator prepares sanctions for overdue payments

The National Commission for State Regulation of Energy and Public Utilities (NRECU) is considering imposing a fine on the State Enterprise "Guaranteed Buyer". The total amount of potential sanctions is UAH 488,240. The primary reason is cited as violations during financial settlements with electricity producers operating under the "green" tariff.

Details of financial violations

According to regulator data, a significant portion of the fine, specifically UAH 321,300, is directly linked to overdue payments to renewable energy producers. In addition to the financial sanction, the NRECU plans to oblige the enterprise to fully settle the debt for specific months of the 2022–2025 period by 31 December 2026.

It is worth noting that the Guaranteed Buyer attributed part of its own non-payments to the debt of the State Concern "Ukrenergo" towards it. This concerned the service of increasing the share of electricity from renewable sources in the generation structure. Taking this factor into account, the regulator reduced the size of the sanction by 70% for the part of the violations that resulted from the non-fulfilment of obligations by other market participants.

Mutual settlements in the energy market

In a separate point, the regulator requires the Guaranteed Buyer to settle with Ukrenergo by the end of the current year for electricity used to balance imbalances in 2025.

Exact figures of mutual debt between market entities are not disclosed in public materials. The situation indicates that financial settlements in the electricity market remain a complex chain of mutual obligations between green energy producers, the Guaranteed Buyer, and Ukrenergo.
