Approval of the export mechanism
On 7 October, the government officially approved the possibility of gas exports for private operators. Under the adopted decision, companies are entitled to export up to 15% of the volumes of gas they supplied to the gas transmission system (GTS) in the previous month.
An expert assessment by ExPro indicates the potential significance of this decision for business: launching exports could provide private producers with over 2 billion hryvnia in revenue per month.
Lobbying activities and interested parties
The Association of Gas Production Companies of Ukraine recorded contacts with the Ministry of Energy in its lobbying report. Specifically, on 30 June, a contact with Deputy Minister Hanna Lihun was declared, during which amendments to the draft resolution regulating gas exports were discussed.
Among the beneficiaries of such lobbying work, the association listed several key market players:
- “DTEK Naftogaz”, owned by Rinat Akhmetov;
- “Prirodni Resursy”, part of Viktor Pinchuk’s Geo Alliance group;
- “ESKO-Pivnich”, owned by the daughters of Mykola Zlochevsky;
- “Zakhidna Draserwis”, owned by Zynoviy Kozitsky.
NABU warning on corruption risks
A significant aspect of the story was the intervention of the National Agency on Corruption Prevention. On 7 July, NABU experts identified a corruption-inducing factor in the draft resolution. The agency drew attention to the fact that the Ministry of Energy was granted the right to independently form the list of companies admitted to exports, without clearly defined selection criteria.
NABU warned of the risks of adopting opaque decisions and the abuse of authority by officials, demanding that the document be reworked. Despite these reservations, three months later, the Cabinet of Ministers still approved the opening of gas exports.
