Courts massively reinstate dismissed Donetsk police officers

Courts continue to mass reinstate officials and police officers dismissed for various reasons to their jobs. This time, judges reviewed and granted the claims of dismissed Donetsk police officers in record time, reinstating them and ordering compensation payments.

 

“Since the beginning of 2015, 533 employees have been dismissed from the internal affairs bodies of Donetsk Oblast by orders of the Ministry of Internal Affairs of Ukraine and the regional headquarters on negative grounds, of whom 479 were dismissed for disciplinary violations and 54 for discrediting the service.
To date, there are decisions by the Donetsk District Administrative Court to reinstate 29 employees in the internal affairs bodies.

The adoption of such judicial decisions should, as a rule, be deliberate and justified, especially after the events of last year, when a number of police officers switched sides to the enemy. And, of course, after a thorough review of the former employee's performance in their position.

But the judges of the Donetsk District Administrative Court have a different view regarding the consideration of claims for reinstatement of dismissed employees from the internal affairs bodies for discrediting the service and disciplinary violations. The average duration of a hearing during which one case was heard and a decision in favour of the plaintiff was issued is 10–15 minutes; a “sad record” of 5 minutes has even been established. What thorough examination of the materials can be spoken of?

The result is that decisions are adopted under which we are obliged to reinstate the dismissed officers and pay them their full monetary compensation. We do not agree with the adopted decisions, so we are further challenging them by filing appeals,” – Vyacheslav Abroskin, the head of the Donetsk police, reported from his page on the social network Facebook.
