Verdict regarding property on Myloslavska Street

The Kyiv Commercial Court issued decisions in favour of the state in three separate proceedings initiated by the prosecution. The court granted all claims, ordering the return of real estate with an area of approximately 150,000 square metres to state ownership. This concerns the facilities of the unfinished Republican Clinical Hospital, located at: Kyiv, 58 Myloslavska Street.

Chronology of court decisions

The review of these cases took some time. The court granted the first two claims on 24 June, while the third, the last in the queue, was reviewed and decided in favour of the state recently.

Case participants and the seizure mechanism

The documents for these cases list four commercial entities: "Khatment", "Kapital-Invest-Resurs", "Mortranserservis" and "Orum Invest". These companies became the owners of the hospital's property as a result of the sanation procedure of the enterprise "Dialir". It should be noted that 95.6% of "Dialir"'s shares were in state ownership.

Prior decisions of the Supreme Court

On 27 July 2022, the Supreme Court annulled the approval of the sanation plan for "Dialir". Despite this decision, on 16 August, the hospital's assets were already transferred to the charter capital of the company "Orum Invest". Currently, commercial courts are officially recognising these transfers as invalid.

Connection with the criminal proceedings

This civil law story is closely linked to a criminal case. The Security Service of Ukraine previously notified Volodymyr Sivkovich, who held the position of Deputy Secretary of the National Security and Defence Council, of suspicion. He is charged with the probable illegal appropriation of the hospital complex and a land plot.
