Court to try organiser of 16-car smuggling scheme disguised as humanitarian aid in Lviv region

A court in Lviv region will hear a criminal case concerning the organisation of the illegal movement of 16 passenger cars across the state border. According to the investigation, the total value of the vehicles exceeds 1.95 million hryvnias. The main feature of this scheme was that the cars were processed as humanitarian aid for charitable organisations, which allowed the avoidance of mandatory customs payments.

Mechanism for bypassing customs rules

Detectives established that the suspect involved 13 residents of Lviv region and other regions of Ukraine in carrying out the plan. According to law enforcement, these individuals acted as carriers who were unaware of the organiser's true intentions. They agreed to deliver the cars from abroad, believing that the vehicles were intended for the needs of charitable funds.

During the border crossing, the documents were processed as if the cargo were humanitarian aid. This status granted the right to move goods without paying customs duties, which became the basis for the smuggling of excisable goods.

Qualification of the crime and investigation status

The pre-trial investigation was conducted by the Territorial Directorate of the Bureau of Economic Security (BEB) in Lviv region. The organiser of the scheme was notified of suspicion under Part 1 of Article 201-4 of the Criminal Code of Ukraine, which provides for liability for the smuggling of excisable goods.

The pre-trial investigation has now been completed. Under the procedural supervision of the Lviv Regional Prosecutor's Office, the indictment has been sent to court. It is the judicial instance that will determine the proof of the accused's guilt in organising the illegal import of vehicles.

It is worth noting that the use of humanitarian aid status must correspond to its declared purpose. An attempt to bypass customs rules through such a mechanism may lead to criminal liability.
