Customs control detects imitation of Apple products

On 16 April 2026, a batch of goods violating intellectual property rights was detected at the "Mostyska" customs post (Customs Clearance Department No. 5 of the Lviv Customs). The customs declaration for the import of goods from Hong Kong was submitted by DOVIRA FINANS GRUP LLC (Zaporizhzhia). In the documentation, the cargo was listed as "MyTeh M1 Pro Original series earphones for Type-C" earbuds, with a total quantity of 1,232 units.

The manufacturer of the goods was indicated as Hoco Technology Development (Shenzhen) Co., LTD, and the trademark as My Teh. However, during the inspection of the cargo, customs officers noted signs of counterfeiting. Clearance was suspended, and official representatives of Apple Inc. were informed about the possible violation.

Expertise confirms counterfeiting

An Apple Inc. representative requested additional detailed photos of the seized earbuds for comparison with the industrial model "EARPHONES", protected by Ukrainian patent No. 29112. The results of the forensic examination (expert conclusion No. 296-01) confirmed that the appearance of the imported goods fully reproduces the protected industrial model of Apple Inc.

Experts deemed the goods counterfeit and falsified, as their design and structural elements imitate the original product without the permission of the rights holder.

Tetyana Ihorivna Kavytska, the head of DOVIRA FINANS GRUP LLC, filed a motion to close the proceedings. She claimed that she purchased the products as the original "MyTeh" brand, and that the expert had only selectively compared individual details of the housing. However, the court rejected these arguments, emphasising that the beneficiary (holder of the customs regime) bears full responsibility for compliance with intellectual property legislation during import.

Court decision: fine and destruction of cargo

On 29 September 2026, the Halychtskyi District Court of Lviv (Judge V.F. Romanyuk) considered case No. 3/461/1936/26. With the participation of customs representatives and an Apple Inc. lawyer, the court established the importer's guilt.

Tetyana Ihorivna Kavytska was found guilty of committing an administrative offence under Article 476 of the Customs Code of Ukraine (import of goods in violation of intellectual property rights). The court ruled:

  • to impose a fine of 17,000 hryvnias (equivalent to 1,000 non-taxable minimums);
  • to confiscate all 1,232 pairs of earbuds in favour of the state and subject them to destruction.

In addition, Tetyana Ihorivna Kavytska was charged with additional expenses: 11,112.40 hryvnias for the storage of property at the Lviv Customs warehouse and 665.60 hryvnias for the court fee.
