Cassation court rejects prosecutor's appeal
The Cassation Criminal Court within the Supreme Court has finally concluded the review of criminal proceedings against former head of the Ternopil Regional Council, Mykhailo Holovko. On 1 October, the judges issued a ruling leaving the decision to close the case unchanged and denying the cassation appeal filed by a representative of the Specialised Anti-Corruption Prosecutor's Office.
Thus, the judicial instance has finally confirmed the position of the Appellate Chamber of the Higher Anti-Corruption Court (VAKS), which previously overturned the guilty verdict and concluded that there was no criminal offence in the actions of the accused.
Chronology of court hearings
The history of the case began with the Higher Anti-Corruption Court initially finding Mykhailo Holovko guilty of submitting false information in his declarations. However, the VAKS appellate instance reviewed this decision, overturning the verdict and closing the proceedings, as it concluded that there was no criminal offence.
The prosecution did not agree with this conclusion and appealed the decision in cassation. However, the Supreme Court supported the decisions of the lower instances to close the case.
Content of the charges
In February 2025, the National Anti-Corruption Bureau of Ukraine (NABU) and the Specialised Anti-Corruption Prosecutor's Office (SAP) notified Holovko of suspicion. According to the investigation, the official did not list an apartment of 201.9 square metres in his declarations for 2022 and 2023. This property belonged to his mother, but, as the investigation believed, Holovko, together with his family, actually used this living space.
In addition to the apartment, the list of undeclared property belonging to family members included a parking space, a car wash, and a storage unit. Investigators also pointed to the presence of undeclared funds in a bank account.
Currently, the decision to close the criminal proceedings is finally in force.
