Intrusion into private territory

Parliamentary Commissioner for Human Rights Dmytro Lubinecs stated that during mobilisation measures, representatives of the Territorial Recruitment and Social Support Centres (TCC and SP) have started entering citizens' private territory and residences.

The Ombudsman's Office has recorded around 10 such cases in various regions of Ukraine.

Entry mechanism

According to Lubinecs, there is currently no confirmation that TCC staff broke down doors to gain access to homes. The typical situation is that owners themselves open the doors or leave them open, after which servicemen enter the premises.

Ombudsman's hypothesis

Dmytro Lubinecs suggested that such actions are of a testing nature. He believes that this is a check to see what the legal reaction will be to similar actions in different regions.

«Я думаю, що це перевірка, якою буде юридична реакція, якщо співробітники ТЦК та СП почнуть заходити навіть у приватні приміщення та силою забирати звідти власників. Тобто спробували в одному регіоні — була реакція, пробують в інших регіонах» (I think this is a test of what the legal reaction will be if TCC and SP staff start entering even private premises and forcibly taking owners from there. In other words, they tried in one region — there was a reaction, they are trying in other regions), the ombudsman noted.

Criminal aspect

The Ombudsman emphasised that the conduct of TCC and SP staff may contain signs of criminal offences.
